SMS Terms

These SMS Terms govern the text message notification program operated by GarbageCake ("FollowUpFlare," "we," "us," or "our") through the FollowUpFlare platform. By opting into FollowUpFlare SMS notifications, you agree to these terms.

1. Program Description

FollowUpFlare operates a transactional business-to-business SMS notification program. When a new lead is submitted through an account holder's connected Meta Lead Ad form, FollowUpFlare sends real-time SMS notifications to opted-in team members ("Recipients") designated by the account holder.

Types of SMS messages sent through this program:

  • Opt-in confirmation: A one-time message sent when a Recipient is added to an account, asking them to reply YES to confirm consent before any alerts are sent.
  • Lead alert notifications: Transactional messages notifying opted-in Recipients that a new lead has been submitted, including a PIN-secured link to view lead details.
  • Claim confirmations: Notifications sent to other Recipients when a lead has been claimed by a teammate, so they know no action is needed.
  • Account alerts: Operational messages about your account, such as low credit balance warnings, payment failures, or important service notices sent to the account holder.

This is a strictly transactional notification program. No promotional, marketing, or advertising SMS messages are sent through FollowUpFlare's platform to Recipients. All messages are operational in nature and triggered by real business events.

2. Who Sends These Messages

SMS messages are sent by GarbageCake operating as FollowUpFlare, using a Twilio-provisioned long-code phone number. The sending number will appear in your message history. FollowUpFlare uses Twilio, Inc. as its SMS delivery provider. Message delivery is subject to carrier availability and Twilio's platform policies.

FollowUpFlare is not an end-to-end encrypted messaging service. Message content may be accessible to Twilio as part of the transmission process, subject to Twilio's privacy policy.

3. How to Opt In

FollowUpFlare uses a double opt-in process for all SMS Recipients:

  1. Account holder adds Recipient: A FollowUpFlare account holder adds your name, email address, and phone number to their account through the FollowUpFlare dashboard. This constitutes the account holder's attestation that they have your consent to add you as a Recipient.
  2. You receive an opt-in SMS: FollowUpFlare sends you a message: "FollowUpFlare: You've been added as a lead-alert recipient for [Business Name]. Reply YES to start receiving new-lead text notifications. Msg frequency varies. Msg & data rates may apply. Reply HELP for help, STOP to cancel."
  3. You confirm by replying YES: Only after you reply YES will any lead alert messages be sent to your number. If you do not reply YES, no further messages will be sent.

Your consent is specific to the account holder who added you. If you are added to multiple FollowUpFlare accounts (e.g., by different businesses), you will receive a separate opt-in request for each account, and your consent applies independently to each.

Account holder responsibility: By adding a Recipient to a FollowUpFlare account, the account holder represents and warrants that they have obtained express written consent from that Recipient to receive SMS messages, as required by the TCPA. FollowUpFlare's double opt-in confirmation is an additional safeguard but does not substitute for the account holder's independent consent obligations.

4. How to Opt Out

Reply STOP to any FollowUpFlare SMS message at any time to immediately unsubscribe from all FollowUpFlare SMS notifications. Upon receiving your STOP message, FollowUpFlare will:

  • Send you one final confirmation message acknowledging your opt-out.
  • Immediately cease sending SMS messages to your number from the platform.
  • Update your opt-out status in the account holder's dashboard.

You may also be removed by the account holder at any time through the FollowUpFlare Recipients settings page, which will also halt all SMS messages to your number.

After opting out, you may opt back in at any time by replying START or YES to a message from the same number, or by asking the account holder to re-add you and completing the opt-in flow again.

You may also opt out of specific types of messages: If you would prefer to receive only email notifications and no SMS, ask the account holder to update your notification preference in the FollowUpFlare dashboard to "email only."

5. Message Frequency

Message frequency varies and is determined entirely by the volume of new leads submitted through the account holder's connected Meta Lead Ad forms. There is no fixed or predictable message schedule.

  • During high lead volume periods, you may receive multiple SMS messages per hour.
  • During slow periods, you may receive no messages for days or weeks.
  • The account holder controls which leads trigger notifications and to which Recipients.

If you have concerns about message frequency, contact the account holder who manages your FollowUpFlare alerts, or reply STOP to unsubscribe entirely.

6. Message and Data Rates

Message and data rates may apply. Standard message and data rates from your mobile carrier apply to all SMS messages you send and receive through FollowUpFlare, including your YES opt-in reply and any STOP, HELP, or START replies. Rates vary by carrier and plan. Contact your carrier for details.

FollowUpFlare does not charge you as a Recipient for receiving SMS notifications. Costs incurred by the account holder for sending messages (via credits) are not passed to you.

8. Privacy and Data Handling

We do not sell, share, rent, or trade mobile phone numbers or SMS consent records with any third party for marketing or advertising purposes. This applies without exception.

Your phone number and SMS consent data are used solely to:

  • Send the opt-in confirmation SMS described above.
  • Deliver transactional lead alert notifications on behalf of the account holder who added you.
  • Process your opt-out and help requests.
  • Maintain consent records as required by TCPA.

Your phone number is shared with Twilio, Inc. solely for the purpose of SMS message delivery. Twilio is not permitted to use your number for any other purpose.

SMS consent records, including the timestamp and IP address of the account holder's consent attestation and your YES reply, are retained for the life of the account and for 4 years after your relationship with the account ends, to support TCPA compliance recordkeeping.

9. Supported Carriers

FollowUpFlare SMS messages are delivered via Twilio's long-code messaging infrastructure and are supported on all major U.S. wireless carriers, including:

  • AT&T
  • Verizon Wireless
  • T-Mobile / Sprint
  • U.S. Cellular
  • Boost Mobile
  • Cricket Wireless
  • Metro by T-Mobile
  • And other regional and MVNOs

Carrier support, delivery speed, and message reliability may vary. FollowUpFlare and GarbageCake are not responsible for delays or failures caused by carrier infrastructure, filtering, or blocking.

10. TCPA Compliance — Account Holder Obligations

This section applies to FollowUpFlare account holders (businesses that use the platform to alert their team).

As the account holder, you are solely responsible for compliance with the Telephone Consumer Protection Act (TCPA), CTIA messaging guidelines, and all applicable federal, state, and local telecommunications laws governing the SMS messages sent to your Recipients through FollowUpFlare. Your obligations include, but are not limited to:

  • Obtaining express written consent from each Recipient before adding their phone number to your account.
  • Maintaining records of consent, including the date, method, and language used to obtain it.
  • Honoring opt-out requests promptly and permanently.
  • Ensuring that Recipients are aware of the nature and frequency of messages they will receive.
  • Complying with all state-specific SMS consent and privacy laws (including but not limited to California, Florida, and Washington).

FollowUpFlare's double opt-in mechanism is a platform safeguard, not a substitute for your independent legal compliance obligations. You agree to indemnify and hold harmless GarbageCake for any TCPA violations, regulatory penalties, or claims arising from your failure to obtain proper consent from your Recipients.

11. Program Changes and Termination

FollowUpFlare reserves the right to modify, suspend, or terminate the SMS notification program, change the sending number, or update these SMS Terms at any time. Material changes will be communicated via updated terms at this URL and, where appropriate, by email to account holders.

If the SMS program is terminated, all SMS messaging will cease and you will no longer receive notifications via text. Account holders will be notified of alternative notification methods if available.
